New Regulations on Rice Export Business

The Ministry of Industry and Trade (MOIT) is drafting a new Decree to replace Decree No. 107/2018/ND-CP and Decree No. 01/2025/ND-CP on rice export business operations.

According to the Ministry, Decree No. 107/2018/ND-CP, issued by the Government on August 15, 2018 and effective from October 1, 2018, has served as the main legal framework for rice export activities. Since its promulgation, it has been amended and supplemented by Decree No. 01/2025/ND-CP, dated January 1, 2025.

During nearly seven years of implementation, the management of rice export activities under these decrees has achieved notable results. However, several issues have arisen in practice that need to be reviewed, amended, and supplemented to better reflect current realities.

Key Structure of the Draft Decree

The new draft Decree consists of 5 Chapters and 27 Articles:

  • Chapter I – General Provisions: 3 Articles (Articles 1–3)

  • Chapter II – Conditions for Rice Export Business and Certificates of Eligibility: 6 Articles (Articles 4–9)

  • Chapter III – Rice Export Management: 12 Articles (Articles 10–21)

  • Chapter IV – Responsibilities of State Agencies and Relevant Organizations/Individuals: 3 Articles (Articles 22–24)

  • Chapter V – Implementation Provisions: 3 Articles (Articles 25–27)

Main Policy Directions and Key Amendments

The draft is developed based on a comprehensive review and adjustment of Decree No. 107/2018/ND-CP and Decree No. 01/2025/ND-CP, following the principles of:

  • Eliminating outdated and irrelevant provisions;

  • Creating a more open, transparent, and favorable business environment;

  • Reducing market entry costs for traders;

  • Improving the management mechanism;

  • Promoting rice export efficiency and competitiveness.

Notable amendments include:

  • Post-audit mechanism:
    Post-inspection of rice export business conditions will now be conducted by provincial People’s Committees, ensuring consistency with the Law on Government Organization.

  • Reduced reporting frequency:
    The number of reports required from rice exporters under Decree No. 107/2018/ND-CP will be reduced, with traders only required to submit one report per month, simplifying procedures and reducing administrative burdens.

  • Clarified responsibilities:
    Adjustments are made to specify the responsibilities of ministries, sectors, and provincial People’s Committees in accordance with Directive No. 21/CĐ-TTg.

  • Designation of focal enterprises:
    The draft revises regulations on designating focal traders for centralized contracts and allocating export quotasto licensed rice exporters authorized to conduct entrusted exports.

New Additions

The draft also introduces new provisions, including:

  • Regulations on corporate creditworthiness assessment;

  • Simplification and reduction of rice export business conditions;

  • Streamlined administrative procedures;

  • Enhanced decentralization and delegation of authority.
