Government Issues Decree No. 01/2025/NĐ-CP on Rice Export Business

On January 1, 2025, the Government of Vietnam promulgated Decree No. 01/2025/NĐ-CP, amending and supplementing several provisions of Decree No. 107/2018/NĐ-CP, dated August 15, 2018, on rice export business operations.

The new decree officially took effect on March 1, 2025, marking an important step in improving Vietnam’s legal framework for rice export management and regulation.

Draft Circular to Update and Streamline Legal Provisions

Following the issuance of the new Decree, the Ministry of Industry and Trade (MOIT) is currently developing a Draft Circular to amend and supplement Circular No. 30/2018/TT-BCT (dated October 1, 2018), which provided detailed guidance on implementing Decree No. 107/2018/NĐ-CP.

The Draft Circular aims to:

  • Strengthen the legal framework and ensure consistency with the national legal system;

  • Enhance the efficiency of state management in the rice export sector;

  • Address existing difficulties and bottlenecks identified during the implementation of Circular No. 30/2018/TT-BCT;

  • Unify amendments between Circular No. 30/2018/TT-BCT and Circular No. 42/2019/TT-BCT.


Key Amendments in the Draft Circular

The main proposed changes include:

  1. Amending and supplementing the reporting schedule for rice export traders, including instructions for electronic data submissions.

  2. Providing detailed guidance on how traders submit reports in digital file formats.

  3. Developing a software platform to facilitate reporting by rice exporters.

  4. Abolishing Article 26 of Circular No. 42/2019/TT-BCT to avoid overlap and ensure consistency.


Legal Consistency and Implementation

The issuance of this Circular will ensure compliance with:

  • Decree No. 01/2025/NĐ-CP, and

  • The Law on the Promulgation of Legal Documents, adopted by the National Assembly on February 19, 2025.

The update aligns with the Government’s efforts to digitalize administrative procedures, improve transparency, and simplify compliance for businesses in the rice export industry—one of Vietnam’s key export sectors.
