
The Government of Vietnam has issued Resolution No. 214/NQ-CP (dated November 4, 2024) regarding the amendment to the Decision of the Trade Committee on revising Protocol No. 1 concerning the Rules of Origin and Administrative Cooperation under the EU–Vietnam Free Trade Agreement (EVFTA).
Previously, Resolution No. 10/NQ-CP (dated January 5, 2024) had also approved the signing of the Trade Committee’s Decision on amendments to Protocol No. 1 under the same Agreement.
Purpose of the Draft Circular
In line with the implementation of the EVFTA, as well as Resolutions No. 10/NQ-CP and 214/NQ-CP, and Decree No. 31/2018/NĐ-CP (dated March 8, 2018) detailing the Law on Foreign Trade Management regarding rules of origin, the Ministry of Industry and Trade (MOIT) has developed a draft Circular providing updated Rules of Origin of Goodsunder the EU–Vietnam Free Trade Agreement (EVFTA).
This Draft Circular aims to:

Update regulations to reflect recent amendments to Protocol No. 1 of the EVFTA;

Simplify and clarify procedures for certifying and verifying origin of goods exported under the EVFTA;

Enhance administrative cooperation between Vietnam and EU authorities in the management of preferential origin;

Support enterprises in maximizing tariff preferences and ensuring compliance with EVFTA requirements.

Background: EVFTA and Rules of Origin
The EU–Vietnam Free Trade Agreement (EVFTA), effective since August 2020, grants preferential tariff treatmentto goods meeting specific origin requirements. The Rules of Origin (ROO) are essential to ensure goods qualify for such benefits.
Circular No. 11/2020/TT-BCT previously guided businesses on these ROO procedures. However, following updates from the EVFTA Trade Committee, adjustments are necessary to align Vietnam’s domestic legislation with the revised Protocol No. 1, thereby maintaining consistency with EU regulations.
